Understanding the EB-3(A) Skilled Workers Visa

The EB-3(A) Skilled Workers visa is an employment-based immigrant visa category specifically designed for foreign workers who possess at least two years of specialized job experience or training in their field of expertise. 

Unlike temporary work visas that require you to eventually return to your home country, the EB-3(A) provides a direct pathway to permanent residency and a green card, allowing you to establish a lasting future in the United States. To qualify, you must have a permanent job offer from a U.S. employer who has demonstrated through a rigorous labor certification process that no qualified American workers are available for the position. Your employer must also commit to paying you the prevailing wage as determined by the U.S. Department of Labor, ensuring fair compensation and protecting the American labor market.

Skilled work refers to positions requiring at least two years of specialized job experience or training, including electricians, welders, plumbers, HVAC technicians, carpenters, chefs, and construction workers. Your experience must be directly related to the job position, verified through certificates, licenses, or employment records. The position must be permanent, not temporary or seasonal.

The EB-3(A) process typically takes 3.5 to 12+ years depending on your country of origin. The PERM labor certification takes 1-3 years, I-140 processing takes 4-6 months, and the final visa application takes 11-30 months. Applicants from China and India may experience longer processing times due to visa quota limitations.

Yes, under the American Competitiveness in the Twenty-First Century Act (AC21), you may change employers after I-140 approval. However, your new job must be in the same occupational classification, your new employer must file an amended I-140, and the position must meet the same wage requirements.
